Mark Maragh is an experienced Attorney-at-Law and the Managing Partner of Amicus Legal. In 1998, Mark Maragh was admitted to the Saint Lucia Bar, after graduating from the Hugh Wooding School of Law in Trinidad and Tobago. From day one, he has been regularly involved in litigation both in the civil and criminal courts, making appearances before the Magistrates Courts, the High Court and the Court of Appeal. He has also successfully appeared before the Privy Council of the United Kingdom. Over the past 17 years, Mark has earned the reputation of being one of Saint Lucia’s best advocates and legal professionals and has been involved in several landmark and precedent setting decisions.

Mark Maragh has led litigation in complex commercial proceedings and sophisticated commercial transactions with a focus on medical negligence, insurance, employment, corporate insolvency and restructuring, taxation, trust, and citizenship by investment. He has advised some of Saint Lucia’s largest and most respected corporations, which include utility companies, oil companies, Port Authority and some of the largest retail and distribution companies on Island. He regularly advises and has been heavily involved in complex legal matters pertaining to the acquisition and construction of hotels, condominiums and other real estate developments in Saint Lucia and has sat on various statutory boards including the Gaming Commission and National Development Corporation, (now Invest St Lucia). He serves as Managing Director to the island’s largest service station and also serves on the board of directors of Petrus Private Bank, a licensed international offshore bank.

Plummer and Anor v Conway Bay Limited (Saint Lucia) [2008] UKPC 3 – Appeared before the Privy Council (as lead-counsel) to successfully dismiss an appeal with respect to a multitude of issues that surrounded the award of damages given by the Judge at First Instance.
Gemyma Norville v The Attorney General of Saint Lucia and The Victoria Hospital, Claim No SLUHCV2004/0362-Medical Negligence against state run hospital – Obtained precedent setting judgment in the High Court which resulted then in the largest settlement for a medical negligence claim in the jurisdiction of EC$2,000,000.00.
Gertrude Ann Daniel v Zeby Howell and The Saint Lucia National Housing Corporation, Claim No SLUHCV2003/0240-Negligence, Builders liability – First reported decision to fully explore the legal basis for liability of a builder for negligent work under article 1588 of the Civil Code and dealing with issues of liability for latent defects in construction.
DPP v Julian and Moeita Adjodha, Claim No SLUHCV2011/1110 – Successfully represented clients in first decision to consider variation or discharge of a restraint order made under the Proceeds of Crime Act.
Royal Bank of Scotland (Trading as NatWest) -v- Caribbean Destination
Management Services Limited and Anr – Precedent setting decision in the jurisdiction, where he successfully argued before the Court of Appeal and established by an oral judgment, that the Court had jurisdiction to review the decision of a single judge of the Court given in a procedural appeal and that the Court retained an inherent jurisdiction and power of review in certain circumstances.
